How to transfer Property own by Grand Uncle

25-Feb-2023 (In Property Law)
My Grand Uncle (Unmarried and Stays with us) since last 60 Years. He wish transfer flat on my name after his death. If we will go by "WILL" then there would be lots of issue in probate because he had 4 brothers and their children and family members, they will also be a part of that serving notice by court and I don't have that details as well. Is there any procedure by which he disown all other members and I can transfer property on my name in future?

Hello,
You can transfer it in your name by way of gift deed thats the only possible way wherein you can secure your right in the property but the stamp duty would play a major role as per your question I believe uncle would be transfering it to his nephew which will attract a stamp duty of 5% if you go ahead with the gift deed registration.

This is my response to you:
1. Then he must transfer the property to you as a gift;
2. Enter into a gift deed, execute it and register it;
3. Also make an affidavit of the uncle stating he does not want to give it to his children;
4. Consult a local lawyer and take steps.
