How to stop transfer of property registered in someone else name
16-Apr-2023 (In Property Law)
Religion - Hindu . Sir, there's a property built by my father for which he even took loan from bank. All papers are under my father's name. We are two daughters to him. Property was built for my grandparents to stay and my grandfather has been living there for last 40years. My uncle also stays with him. We want to sell out this property before it becomes a dispute. My grandfather intention is to give away this property to my uncle through illegal means. As per my knowledge the transfer of property is not possible legally as all papers are under ny father's name. Can u suggest best solution to sort this matter.
See the bank gives loan in the name of owner only and as you are your self stating that all the papers are in the name of your father only so there is no dispute over the ownership. But as per the law limitation you should file a suit within 12 years for possession of property otherwise the person in possession becomes owner of the property by adverse possession. Hence, the best solution here would be to sell the property to someone by showing him the papers that they are in your father's name and then that person can file a suit for mandatory injunction and eviction.
