A rightful claim of partition has legal recognition and hence can be enforced in the court of law. However a peaceful and practical family settlement is always possible among the warring parties either through the court or outside.

Yes, the Court can stop partition of the property. But that depends on certain facts. Please clarify whether you have a WILL in your favour? What is your share in the property? How is it adversely affecting you?

Aapki sehmati k bina koi bhi property me aapka hissa sell nahi kar sakta. Agar aap property me kanooni taur par hissedar hain to aapke pas legal notice aayega, usme property me aapke hisse jaisi kayi or jankariyan hongi, agar aap us legal notice ka jawab samay-seema rehte nahi dete hain to property k bantware ka case file kiya jayega or agar aapko koi aapatti hai to aapko foran legal notice ka jawab dena hoga or usme bantwara rokne ki wajah batani hongi. Aap chahe to Caveat Suit file kar sakte hain Lower Court me pushtaini property k case me, usme aapko prarthana karni hogi ki aapko party banaye bina koi order aapke against pas na ho kathit property k sandarbh me or aap chahe to apna hissa alag karne k liye partition suit file kar sakte hain jiske liye aap chaho to registry office me bhi ek petition file kar sakte ho kathit property se sambandhit bantware ya bechne k bare me aapko batane k liye.
