First of all you need to be clear about the title of the property and for that you should obtain the encumbrance certificate from the sub registrar office. After that if there are any lacunaes you can file a suit for specific performance against the seller of the property to you and if the same proves to be fruitless then you can file a suit for recovery to take back the amount spent by you.
