how to know whether penalty will be levied on vacant property?

Hi Sir/Madam, I own a plot in Bangalore. As per the recent changes, vacant site attracts penalty.As per that, Sites greater than 30*40 and less/equal to 40*60 has penalty of Rs. 80,000 AND sites greater than 40*60 and less than 50*80 attracts penalty of 2,50,000 Rs. When my site is measured it shows the dimension of 2403 sq ft. Should i still pay 2.5 Lcs; because the site was sold to me as 40*60 and i am paying the tax for 40*60. Why should i pay 2.5 Lcs instead of 80000? Please suggest.
Penalty can not exceed beyond what has been prescribed by the statute. If the measurement of site is within the bracket of Rs 80,000/- collection of charge beyond it will be illegal and can be recovered by invoking jurisdiction of courts.
