How to initiate settlement of property through court

hello sir, myself ronak from gujarat. my father passed away few years ago and my fathers family has a total of 3 brothers and 4 sisters. we have an ancestral property(flat) located in ahmedabad city and currently occupied by my unlce staying there. regarding to it he is not interested in any sort of property settlement among the family. is there any way to send him notice regarding this dispute. all the brothers and sisters are mutually agreed to make the partion regarding the flat but my uncle is not willing to make the partition. please suggest me the way of settlement through court or any sort of court notice which can be sent to him.
