How to get permanent injunction against panchayat
02-Feb-2023 (In Property Law)
We are facing an issue with our gram panchayat and neighbor land holders they occupied panchayat road so the road got shifted to our land we just want to get permanent injunction order against panchayat and to take legal action against our neighbor land holders. Can you please advice your suggestion about time and cost related parameters in our situation.
Firstly you have to prove that the previous road was maintained by the Panchayat. Do you have documentary and oral evidence that the road is a panchayat road and it is occupied by your neighboring land owners? You have to file a suit for declaration of title over your land area which is used as a panchayat road now and also seek permanent injunction as a consequential relief. You have to file the suit against all your neighboring land owners and the panchayat. The case will consume time. If all goes well it may take two to three years of litigation which depends upon the volume of matters before the Court. Or meanwhile there may be settlement or compromise through Lok Adalat if possible after filing of the case. Once the dispute is settled in Lok Adalat then either parties cannot go in appeal and the order will be final. You have expenses like Advocate(according to the demand of the advocate which might be negotiated ) Court Fee, Process Fee,, drafting charges, typist charges, stationery charges , advocate clerk's fee etc.
