How to enforce partition of hindu joint family

Good evening Sir/Mam My mother owns a Plot ,Since 15 Years one of my cousin was running a chemical manufacturing unit in two plot one is in my mother name another in his mother name...Since 5 years unit is idle and not running ..We are joint family and as its joint family we didn't made any agreement .Our religion is Hindu and we have already filled a case of eviction ..We have filed for injunction order inspire of getting injunction order he have let out one portion for rent...Seeking genuine guidance ... Thanking you
YOu will have to first ask the said cousin if he is ready for the partition. However, in your situation, you already filed a case for eviction, now go ahead with the proceedings of the same, as partition in only possible in case of Hindu Joint Family property and as it is registered in your mother's name, it is her self acquired property. Now, you will have to file a case regarding the declaration of the said property and if the plots are adjoining then you can also, apply for demarcation of the said property.
