How to do Plot partition in Bihar as brother not coming to sign

Hello I am manish I asking a question my father have 3 brother 1 brother is living in Kolkata he is not coming to plot parition this person is other minded but this person sign is must. but without sign how to do a cleartion a plot of only 2 brother plz sir I request you my father is belong a very fear how to do
Family settlement cannot be done without the signature of all the brothers. If there is no signature then you cannot have the family settlement of partition. You can file a suit for partition in the hon'ble court and seek partition through the court.
