How to do distribution of deceased mother's jewellery

14-May-2023 (In Property Law)
My mother died in year 2006. We are 7 siblings but we do not have taking terms with each other. How to divide amongst us our mother's jewelleries lying in iron safe in the room of my elder brother I do not have access. My elder brother wants to keep the jewelleries himself. What to do ? We have a list of ornaments signed by all 7 of us.

Dear client,
As you have a very important documents relating to the moveable properties of your mother signed by all the concerned parties. You can send notice to all of them seeking distribution of moveable properties and in the event of their failure to do so you can file partition suit for separation of movable and imovable properties of your ancesters.

As neither party is in talking terms you may initially send a notice for partition of the jewellery by intimating all parties which should be done within a specific period of time unless otherwise you can file a declaration suit against all parties for division of your mother's jewellery.

You have not mentioned in your question whether your mother died tested or intestate . What about your father ? Whether he is alive or predeceased? Taking into consideration that your mother died intestate in that event all the movable and immovable properties are to be shared within the legal heirs in equal part. You may seek intervention of your family friends and other members in whose word all your family members have no objection , the said person will distribute the things in equal ratio and obtained consent of all the persons in a minutes which will evident in case any one raise any dispute in future or else you may seek legal redress by filing an application in the court for appointment of an receiver for distribution of the movable or immovable properties amongst all the legal heirs.
