how to distribute the property after parents are deceased

04-Jun-2023 (In Property Law)
Hello , My parents are no more now and after their death, their properly distributed to all of us. Me and my sister are only 2 child and now we both got married. after my mother died. my sister gave the "sahmati patr" that she wants to give her share ( Properly ) to me on 1000/- Rs stamp paper. but now she filed a case in "Tahsilli" as this is forming land. in all the paper like "khasra" / " rin pustika" has my name on it. Can she still get her share ( property ) or is there way on this ?

If she has already given you her sahmati patr (no objection certificate) then this means she has relinquished her right in your favour. Now she can't get her share.

If the stamped sahmati patr has been duly executed and also has signatures of witnesses on it, then you can file this sahmati patr in the case she has filed in Tahsili. And if the witnesses who had witnessed the sahmati patr also give their statements in your favour, you will be easily able to prove your right and her false claim.
