How to claim the property of Uncle who had no children.

My uncle expired recently. He was single person at the time of expiry (No children, wife, mother and father). He had a bungalow which is at present in the custody of his nephew ( His wife's brother's son). Now my question is who will be the legal claimant of his property.

When a person died intestate without creating a will then all legal heirs inherit the property by way of succession. In your case all your children & you have equal right over the property. Thanks & Regards.

Assuming that the uncle that you are mentioning is your paternal uncle, you have absolute right in his property over his nephew, You need to procure all the documents to prove your relationship with the deceased person and then proceed against your uncle's nephew for declaration of title and recovery of possession.

You have a good case on merit.
You have to file suit for recovery of property from your aunty's brother's son in a civil Court. You should be ready to pay Court fees on the market value of that property in addition to other cost & expenses.
