How to carry out the partition of a gram natham house

we are four brothers with mother. The house is ancestral property which is in grama natham,The younger brother try to swallow the full property by giving low amt. he says this natham land so we do nothing .he try to get mothers share also. BUT according to our grandfathers will all of our properties should only gose to our father and four sons. The last brother tries to occpy full of front portion and try to construct new building. how to make partition and get a patta. what is the legal remedy pls tell.
First of all approach the court and get the will probated if an executor has been appointed otherwise you can obtain letter of administration from the court. Accordingly, the properties would be transferred as per the will and you can get the properties registered in your name and your brother's and mother's name as per the direction given in the will. Later on if you want your separate share then you can file a suit for partition and have your share in the property.
