How much time will a Partition suit take to be executed muslim law
22-Apr-2023 (In Property Law)
My grandfather had 3 properties in Mumbai and 2 in Gujarat. He expired and now there are 3 parties claiming i.e my mother(as my dad expired), his brother and his sister. My uncle transferred one of the properties to his name before even asking us. And other properties yet remain in my grandfathers name but they're not willing to settle. How long will the suit last? What will be the cost for it? Is there any alternative way through mediation? This question has been asked keeping in mind that we're Muslims.
please note that as far as one of the property transferred by your uncle in his name is illegal as the other brother and sister have equal right and the remaining property you can mutually among yourselves and prepaid family arrangement /family settlement for the distribution of the property among three children including the children of one of the brother who have expired. also note that is any will left behind by your grandfather? if yes than the property will be distributed as per the will.
