Generally, a final decree in a partition suit can take 2 to 5 years, depending on various factors such as: Complexity of property and number of parties Whether there’s a dispute over title or shares Court workload and adjournments Whether preliminary decree is challenged in appeal Need for appointment of a commissioner for division If there is no serious contest and parties cooperate after a preliminary decree, the final decree (actual division and possession) may be passed within 6 to 18 months.
