How can we ask brother to vacate the ancestrol house

We are 5 brothers and 3 sisters from a hindu family.Parents -No more.No will also. Parents have built a house on 15'x45' plot in 1980.All 4 brothers & 3 sisters want the house to be sold and share the sale proceeds among 5 brothers and 3 sisters equally. One adamant brother who is staying there is not ready to vacate for this purpose. How to make him to vacate the house legally ? Pl advice
All of you have equal share in the property.
All of you jointly send a legal notice to your brother informing your consensus to sell the property on the grounds that all joinders need equal share.
Whether he replies or not, move the Court jointly for partition of property.
