How can i solve double registered land?

Hi All, My father bought a property of 5 acres at Coimbatore, Tamilnadu in 2007. The property owner had already sold the land to a seller. Meanwhile in a couple of months before it reflects into patta, the land was sold to us as well by the same property owner. After certain period when we got the patta we figured out the property had been registered twice and we are in the second place. At this situation, I seek your advice on how can we proceed legally? Do we have right over that land as my father name is displayed in the patta? Is is possible for us to get back the money or property legally? Thanks in advance,

You can file a criminal complaint under section 420 IPC against the seller mentioning that the property which was sold to you earlier has been resold to another person. Get the copy of the second registry and attach both the registries along with the complaint.

Further you can file a civil suit for cancellation of the registered sale deed. I suggest you take both civil and criminal actions simultaneously, this increases your chance of success.
