How can I get NOC from builder for resale of flat

For resale flat if society formation is not done by builder then the is demand of NOC from finance company for disbursement of loan. Is it necessary to give money to builder for NOC else is any alternative is available way to get NOC from builder without money. Why finance company's lawyer do not send a legal notice to builder asking his objection for this transaction. Builder can not raise any objection . He can issue a NOC with taking charge but he will not be able to raise the any objection . What is the best solution?
