How can i claim property of grandfather

30-May-2023 (In Property Law)
We had our grand father property , agriculture lands in Bhopal which was being controlled by uncle , now deceased, now his sons have the possession. Our father migrated to Pakistan, ( now deceased too ) we three daughters and one son are now citizen of US and Canada. Does Indian law supports inheritance in such cases. P.s two of the siblings are born in Bhopal. Please advise.

You are having a good case . You can claim the property by filing a civil suit for partition against your cousin brothers. If the property is on your grandfather's name then I think there will be no problem for you buy if the property is in the ownership of your uncle then there will be difficulty for you .

Law of inheritance, is applicable to the person even migrated to other country and on the basis of grand father ownership, revenue record suit for declaration to the effect that you are entitle for possession on the basis of Indian succession act being leagal owner of the suit property

opinion:

yes, you have a very good winning case on merits as the Indian law of succession will very well protect your rights in the property of your grandfather and father. you all will get equal share in the property. you need to file a civil suit for partition ad possession of the property in Bhopal Court. We have office in Bhopal as well and we handle such cases.
