Housing Society Maintenance unreasonable what to do
19-Jun-2023 (In Property Law)
As I understand, for housing society, there is by laws. Our housing society have 80 :1-BHK and 16 : 2-BHK. Initially we had taken flat maintenance of Rs.1500 from all. But now society is saying we have to calculate it as per sqft. So as per it, 1 bhk maintenance is reduced to 1450 and 2 bhk maintenance has increased to 2100. We 2 bhk people are asking them to calculate maintenance as per by laws, because of which everyone will get justice. But they are not ready for it. As I believe following by laws is mandatory and in by-laws maintenance calculation details are given. But can a society ignore that and follow their own rules by majority?(As they have majority ) Please suggest.
This is my response to you:
1. Send them a legal notice;
2. If that does not work then complain to the registrar and;
3. Method of last resort is to file a complaint in the co-operative court;
4. But before taking legal steps call for an urgent meeting and ask for the amicable settlement of dispute.

As per your query Housing Society Maintenance unreasonable what to do? Housing society to fallow there by-laws and maintenance charges will equal to all flat owners. By-laws are binding on all society members if majority the take decision and amend by-laws in only that time they can receive the amount in different types. Like low charges for 1BHK and high for 2 BHK. If there is no any amendment in by-laws than you able to appose. And deny for excess payment
