Housing society imposing unnecessary fines and what action to take

21-Oct-2023 (In Property Law)
I have questions regarding issue with by apartment asscoiation imposing unnecessary fines on grill work in the utility area. The assciation has imposed a guideline document after we built the grills, they mention it as outside the building boundary and have imposed 5k/month as fine. Am in the 7th floor and not encroaching any common area. I wanted to undestand what rights I have in this case and is there a provision in law for association to impose such fines. The grill am talking about is 4 ft by 4ft and the grill is extending just 6 inches outside my wall premises.

first you have to see this society is registered or not. then if penalty has been levied upon you ask association to furnish copy of resolution passed in AGM to levy penalty on the defaulters. you go through the society bylaws first., and you can see an y such bylaws they passed in the resolution and if association does not forward copy of resolution then issue legal notice. if you need more info you can contact me will suggest you.
