Harassment by neighbors, objecting our construction

20-May-2023 (In Property Law)
Dear sir/Madam, I have a house with a common wall to the other house which belongs to my relatives only. we have property & personal issues with them since 25 years. I have started new house construction in my part. Prior to the starting of my construction i have assured them in presence of mediators, there will not be any damages to the wall and foundations, if so i will make the repairs like plastering and painting. I have demolished my house and left 2 feet from the common wall (where i have a share in the common wall) and constructing my house with all possible safety aspects. They are also harassing with some senseless reasons like, they are asking for the share in municipal road which is on my building side, which even does not belongs to us. 1. During construction they are coming in to our site and trying to stop our work by bullying us. My parents are old and getting mentally worried. Please suggest can i take any injunction order or any other action against them for harassin

You can ask them not to enter onto your property and if they still come and disturb you then you can file a police complaint for trespass for 441 of IPC, 1860.

It is not acceptable for a person to do work that could cause damage to the property of his neighbor. I think you have a case for negligence or nuisance if your wall has been damaged. 25-Jun-2021

What can I do if my Neighbour occupied a part of my land and illegally constructed a house?

In order to file a case against illegal land occupation, you must first draft a complaint, pay court fees and submit it to the appropriate court. The court will send a notice (to your neighbor) and proceed with the legal procedure.

Can a Neighbour build up to my boundary?

The Party Wall Act allows neighbours to build up to their party wall without permission. The neighbours can build on their land as long as it does not impact the neighboring properties. You can ask your neighbours to let you know if they have done any house extension or work on their property, but it is not mandatory. 09-May-2023
