Guidelines regarding the amendment in construction agreement

24-Jan-2023 (In Property Law)
I already referred this link, but looking for some more info https://www.kaanoon.com/20225/change-unit-in-under-construction-apartment-after-registration I have booked a 2 BHK apartment for which UDS Registration and Construction agreement registration are complete. Sale Deed registration is not done yet. During construction I found that illumination is too poor and asked my builder about change to a different unit in the same apartment building, for which he readily agreed. Bank loan disbursement is done up to this stage (3rd floor stage, total 4). I have two questions here. 1) Should I have to prepare a new construction agreement for the new unit (or) is it possible to register a change of unit in the same apartment building (to bring down stamp paper and CA reg charges)? 2) Can the same bank loan be modified for the new apartment unit?

As the referred link involves a total different sale from a 2 BHK to a 3BHK however, for the same purpose if you wan to do so you will have to make a new agreement as previous one stands voids as soon as you decide to go for a new flat, however, you will have to ask from the loan sanctioning authority to make the necessary amendments in the loan as you are now taking loan for a whole new apartment which is totally different from which it was agreed for.
