Gift deed share of property to brother.

We, two brothers and one sister, have ancestral property in Delhi. After my father's death , in the absence of any will, with mutual understanding mutation of the property was done in favour of our eldest brother, and registered in the office of registrar of our area in new Delhi. Now we wish to demolish old structure and construct two floors above the parking area, with equal share in the property. My query is: 1. Can my brother make a registered gift deed in my favour before the actual construction starts. 2. What are the other remedies for the sharing equally between we two brothers. 3. Our sister has no interest in the property.

A gift deed may be drafted and registered with the appropriate registrar. A mutation entry may accordingly be made in your favour. Further and better particulars are needed for an effective opinion. For any other queries, please feel free to contact.

you need not make a registered gift deed. you can partition the property with metes and bounds amongst yourselves. it will save you the expensive registration charges. you need not worry about the mutation because mutation does not confer title.
