Since the gift deed was executed but the transfer was halted by CIDCO, the property remains in your mother's name legally. Before registering the Permanent Alternate Accommodation Agreement (PAAA) with the builder, you should check with CIDCO and the builder whether the transfer can now be processed. If CIDCO permits, resume the transfer in your and your wife's name before registering the PAAA. Otherwise, the PAAA must be executed in your mother's name as the legal owner. Consulting a property lawyer is advisable.
