Gift deed in sister's name should I take witness sign before buying
05-Jan-2023 (In Property Law)
Property Background: the Owner has gifted his flat to his sister and made gift deed. I am planing to buy flat from his sister. the flat is in south Bangalore. i have consulted my friend who is practicing Law. He advised me to take witness signature from original owner who gifted the flat to his sister. But sister not agreeing stating that the flat is in her name, why need witness signature from his brother. Note: the Present EC is in Sisters name only. Now shall i buy the flat with witness signature from the brother?.
The witnesses need not include the brother that you are referring to. It is not required however it would make your documentation harder to dispute which is why your friend advised you to do so in your best interest. Ensure that the documentation is proper, stamp duty is paid and registration is done. That is all that is required. Feel free to get in touch if we could be of any further assistance to you.
