gift deed can be done if there is stay order on partition suit ?

I have filed a extortion of property against my relative and after my petition my relative filed a partition suit for the same property. Now my question is can I ask for stay order on that partition suit on first hearing? or if I do not ask for stay order on 1st hearing can I ask for it after as the section 389 addition is pending in session court. also if any gift deed can be made if a stay order issued on the same property?
