Formal supplementary agreement
31-Jan-2023 (In Property Law)
I HV purchased an under construction flat in a building. We have got the flat agreementregistered stamp duty paid. In this agreement it is mentioned possession will be given in December 2018. Now Construction has stopped from Oct. Now builder states we need to make a formal supplementary agreement as he is planning to give possession of the flat in June 2019 with occupation certificate. What is this formal supplementary agreement the builder is asking to take make and register? I know only one agreement is made for a flat. Can someone help me
My Response to your query:
Builder fails to give possession within time due to this reason to avoide future complaint from buyers he want to protect himself by way of extention.
If you have trust mutual understanding you can go with that supplementary agreement.
If you not agree for that buyer can ask rent from builder as per recent amendment.

This is my response to you:
1. Yes you don't need to sign the supplementary agreement;
2. The builder seems to be playing delay tactics and prolonging the possession of the flat;
3. Is the project RERA registered?
4. You can consult a local lawyer, discuss full facts and take steps.
