Sir, There is an agricultural land of 3.75 Acres. The whole 3.75 acres was used by only one person named "A" for farming. Now, B have made sale agreement for 3.75 acres. However, out of this 3.75 , only 2.75 was reflecting in form-1B in the name of A. Hence, A has made a sale deed to B on this 2.75 acres only. Now, the problem is with the 1 acre left: - The 1 acre is divided in to 3 to 4 survey numbers. In the 1B form , for these survey number it is showing some other names like C , D , E. But, A is saying that it was used by him only and no one of C,D,E has made any problems. When we checked the EC for these survery numbers, it was not clear as this properties were given as part of settlements in the years 1965/1970's. After 1970 no transaction was made on this survery numbers. now the question is : - Is it possible for 1B to go wrong? - Also, for eg : Survery 60/3 is saying as 0.5 acres in 1B, but in reality on ground it is 0.72. Can it be wrongly entered in 1B? -

Yes it is possible as it maybe a result of clerical error. However, regarding the issue, 'A' must immediately file for either a declaration suit in the jurisdictional civil court or should aaply for demarcation in the registrar's/tehsildar's office.
