Forest department community president
26-Apr-2025 (In Property Law)
President of forest department community has informed us to sell their land ,becz we are another community, Even though we had possession over the land in that community. As we have 2 + cent of land in that specific area .Where the person claim,a d suggest,we need to sell our land to their community persons only,if not they won't allow use to build our home in our land .
The claim made by the president of the forest department community—demanding that you sell your lawfully possessed land to members of their own community and threatening to obstruct your construction—is legally untenable, unconstitutional, and amounts to criminal intimidation under Indian law.
First, Article 19(1)(e) of the Constitution of India guarantees every citizen the fundamental right to reside and settle in any part of the country. No individual or community association has the authority to restrict land sale or construction based on caste, religion, or community identity. Such restrictions are void under the Transfer of Property Act, 1882, and any attempt to enforce them can be challenged in court.
If your title and possession over the 2+ cents of land is lawful—through a registered sale deed or patta—you have every right to construct a house on your property, subject only to local municipal or panchayat approvals. The demand to sell only to members of their community is discriminatory and violates Articles 14 and 15 of the Constitution.
Further, threatening to obstruct construction may attract criminal liability under Sections 503 and 506 of IPC for criminal intimidation. You can:
File a complaint with the local police station seeking protection.
Lodge a complaint before the Revenue Divisional Officer (RDO) or Tahsildar for interference with peaceful possession.
Seek a civil injunction from a competent court restraining them from interfering in your lawful possession and construction.
