this land belongs to my father and uncle and my father built a house on this land. My uncle and his family use to stay in this house as we were always based out in city and we use to visit it once in a year and my uncle died 5 yrs ago and now the house is occupied by his children and now we are asking them to leave the house and we are offering them similar land but they are denying to move out. This land still belongs to my father and my uncle
so once he had died he must have left a will also whether ancestral or self acquired property you can go in for partition suit whether the court will devolve the property uncle died and now you are offering them similar land
