Flat to be used for commercial purposes

15-Feb-2023 (In Property Law)
One of the member in our Society wants to give his Flat on rental basis for commercial purpose (May be to Bank or FInancial Company). We would like to know if the committee has authority to allow the members to give his flat on rent. Do we have to obtain any permission from Local Authority like Municipal corporation??

If the property is in a residential area then how are you letting the owner give it on rent for commercial purposes. Committee does not have to take any permission unless the same is for residential purposes

Please check the society bye-laws. Whether it allows the commercial usage of the flat. If it does, then the society can issue NOC. And no permission is required from the municipal authorities. Please however, ensure that a copy of the registered leave and license agreement is submitted to society for record purposes.
