Flat Number Change After Redevelopment Agreement
20-Dec-2023 (In Property Law)
Hi Team, My building had gone for redevelopment in 2013 and we were alloted flat no 802 and agreement for same was registered and excess stamp duty was paid. however in 2014 due to some new FSI policy our building was changed by builder and we were alloted flat 702. now builder had given us a rectification deed which was on 100rs stamp paper and notarized.however same was not registered in stamp duty department.
now im facing issue while selling same as rectification was not registered. pls suggest what do I have to do in this case so I can get my property title clear and transfer the 702 flat in my name
You can send the builder a legal notice to execute a rectification deed.
In order to sell the property, it is important that you execute and register the rectification deed. otherwise, you may not be able to sell flat no. 702.
As a last resort you may think about the court for necessary directions.
