flat in mumabi in my fathers name willed to me through registered will and nomination also regitered in my name in societys membership register . my father died in jan 2013 willing the flat in my name. the flatis in mumbai . its now in possession of my sister in law who ius widow. age 64 years. my age is 61 years . she refuses to vacate the flat. her case filed in family court against my father was dismissed by the judge as the matter was outside its jurisdiction and she was advised to go to civil court with proper papers which she does not have. she had merely filed an appeal in high court . its pending there since 2010 .pl advise
This is my response to you:
1. You can file an application in the High Court in regard to the pending case and get it dismissed for want of jurisdiction;
2. You can file a fresh case in the High Court in the nature of suit;
3. Also file an application for stay and injunction against her;
4. Consult a local lawyer and take steps.

Your sis in law not followed proper way..
You can get update of Appeal High Court matter. After final order you are able to possession. else check status of High Court matter..
