Father inlaw gave property to wife now she is dead how to give it back

07-Dec-2023 (In Property Law)
My Father in Law Made a Settlement Deed of a property in Chennai towards My Wife. My Wife has passed away so is My Father in Law. My Only Son & Myself are the Legal Heirs. Both Self and My Son Wish to Relinquish this property to My only Brother in Law ( My Wife's only Brother) without any monitory consideration as a mark of respect to my Beloved Wife. Please Advise How this should be performed? Should My Brother in Law to pay 7% Stamp Duty to receive this property?

You can execute a relinquishment deed in favour of him. you can either gift him your share of the property. IN gift deed you will not have to pay any stamp duty if its given in blood relation. Make sure gift deed is registered.
