father expired brothers not giving me share can I claim the property

My Late father owns a property (1bhk ) and we were four brothers, the society transfered it to my mothers name now my both 2 small brothers expired ,my mother also expired on Sept 15 I am the 2nd son and after my marriage I live separate , now my elder brother is trying to acquire the property almost ( at present my aunt is living and she favors him) my aunt confirmed verbally that i am included in nominee) but she is not giving me any proof of it. Whenever I raise this issues either she ignores or gets angry. What legal action can be taken if at all they refuse to give my share.
If you want to claim your rightful share in the coparcenary (joint family property) then you must file a suit for partition.
