Father bought plot and let brother stay in it now brother not leaving
22-Feb-2023 (In Property Law)
My father bought a plot in 1973. There is one step brother who used to stay in the plot and was told by father that one father got retired they should vacate the plot. But now they are denying to vacate the plot and has also made a plot on it. What action can i take? What are the chances of getting the plot back?
You may file a suit against him. you have to prove that your father has not taken any rent / lease fee from him and its not let out on any conditions of lease or rent. ITs just to help him out you father has asked him to stay meanwhile he is in service. Whether the outgoings of the utilities and taxed are paid in your name. IF you success to prove that the plot is in your name, you haven't let out the said plot to him on lease or rent, then you will definitely get your plot back.
