Father bought house in grandmother name now she is giving it to others

20-Nov-2023 (In Property Law)
My dad brought a land from my mom's dowry money in Shahpur and later constructed out first family house. Since my dad was in defence he was frequently posted across India and my mom moved along with him. To make things easier like getting gas connection and electricity dad decided to buy land in my grandmother's name. My father had 2 more younger brother one of whom is still not working.when my dad was alive grandmother used to say that once the other uncles children get married and settled she will transfer the property to him or my mother. But now she has becomes biased and say will divide and randomly give property to all 3.This wasn't ancestral property. My mom is subjected to abuse and violence to leave property as we have property at other place as well.My mom has already complained against that but now we are looking for taking legal action and file suit as the house was made by lot of sacrifices from my mom and dad. And we want full claim. What are our chances?

Your query is silent on whether the property purchased through GPA or sale deed. If it is in unauthorized colony then we presume that registry would not have taken place.

Further, if the house is in unauthorized colony we cannot go to court also for relief because the government do not provide benefit to such colonies.

However you can ask your mother to pay the money which you gave her through loan by filing suit for recovery.

You will have draft the suit in such a manner that you gave loan to your mother which she does not intend to return.
