Farming Land Partition Process in UP

19-Sep-2023 (In Property Law)
Hello, we have ancestral agricultural land which is currently joint. We intend to go through partition process soon. We want the partition to be fair and done in a friendly manner. We want the land ownership to be documented legally. we are looking for a lawyer who can guide us and there are no future disputes with regards to land. Also, can I have joint ownership of land with husband and get a Kisan credit card because I intend to do farming in the village. The land is in eastern UP and belongs to my husbands forefathers. Thanks for your help!

The best way to proceed forward is to proceed through court as that would minimise the scope for future dispute which may arise in due course of time. Since it’s an undivided agricultural land the process is to file a suit for partition before the revenue court and get the entire parcel of land partitioned by metes and bounds through court. Since the entire process of partition shall be ratified through a decree of court there is zero possibility that the future generation might not adhere with the court’s order.
