Failed to pay full money after property settlement date

21-Feb-2025 (In Property Law)
If the property party gives an advance and after the date, he does not pay the full amount. And he threatens to get the money back. What should we do about it?

If you have the agreement to sell, you can file a suit for specific performance. In the concerned district court. Initially, you have to send a legal notice to the buyer, demanding the amount due to you. and after the lapse of the specified period of time, you can file a suit.

If agreement to sell has been executed between you both then you can file suit for specific performance under special relief act. As ATS bound the other person to execute the same. We need to first send him notice to get the ATS registered and do his part performance and if he doesn’t turn up then we have to file the case Plz b in touch
