Exclusion of one from list of heirs of intestate after an undertaking

Can the name of a heir be excluded when making an application for inclusion of names in 7/12 utara of land belonging to intestate, if the said heir has given his share to other heirs by making an undertaking to that effect?
It is understood that the person to whom the property belonged has died without making any WILL. Hence, in this case you will require to obtain Letter of Administration and submit the NOC or any other understandings or arrangements with the other existing heirs and only after receipt of order from the court to that effect you can include your name is the said property excluding the name of the other legal heir if the order of the court specifically provides to exclude the name of the other legal heir from the said property.
