Elder brother refuses to give property papers to younger

During 1971, parul das came to india alongwoth her husband and 4 children, GOI provided the place to live to them during course of time one child died and only girl got married, now two person live at that place Elder brother Badal and younger Dipak. Elder has one son and younger has one daughter, on asking for separation the badal refuses that he do not have papers of the property but infact he has, he is not giving the papers to dipak so that dipak can register his part of property on his name. Badal wants that when dipak dies all property will be in badal's sons name. I am dipak's son in law and I am looking a way out of this situtation. Note: Dipak has a xerox which states that the property was given to his mother Parul and the original is with badal

First of all both the sons of Parul das should acquire succession certificate and legal heir certificate. After that Dipak should file a suit for partition. Consequently the court will itself take the responsibility of dividing the property between legal heirs by metes and bounds. After that he is unwilling to bring the documents on record, you can produce the photocopy only before the court and also file an application for production of documents before the court whereby the court will itself call for the production of documents.
