Elder brother not willing to divide fathers property, what to do

Hello Sir/Madam, My GrandFather owned properties and they now belong to his sons ( My dad and his two brothers). There was family dispute and my uncle left with all the property papers and is not willing to divide the property. He abused my dad when he requested for partition(for our education). My dad doesn't want to take any legal action because he still considers my uncle as his younger brother. But I want to do something, my uncle knows that we are in need and is still not willing to help. I would really appreciate to know what can be done here. I only know that it is illegal to keep everything to yourself when it actually is supposed to be divided to all three of them. I'm not sure if it is even right to reach out for help like this.
