Effect of deviations from approved plans

Hello, I plan to purchase a 13-year old apartment (on 3rd floor) on resale Bangalore. The builder has built pent house (4 flats) in the top floor (4th floor, above the apartment on sale) of the building (they call it Builder's floor) , which is not in the approved plan. There has been no problem from BBMP/Govt on this for the last 10 years. Will they demolish the extra floor in future; is it advisable to purchase this flat with this deviation, though this does not affect the apartment I plan to purchase. Thank you.

definitely it will not affect your floor and there will be demolition order immediately instead of that BBMP can impose fine and issue a B khath. if there is A khatha for your property then there will be no problem
