Documents required for apartment purchase

28-May-2023 (In Property Law)
Hello, I would like to purchase an apartment in Hyderabad. I will be the second owner of the flat if I purchase. The present owner of the flat purchased it from a builder. Panchayat approval is not the name of the builder but it is on the name of the previous owner of the land. Builder has purchased the land from that person. Is it necessary to have permission on builder name?I have consulted a lawyer. He has objected it. I would like to take second opinion.

In Hyderabad, it is generally necessary for the builder to have obtained the necessary permissions, approvals, and clearances for the construction of the apartment building. This includes approvals from the relevant authorities such as the local municipal corporation or development authority. These approvals are typically obtained in the builder's name.

If the panchayat approval is not in the builder's name, it may raise concerns about the legitimacy of the construction and the transfer of ownership. It's essential to understand the legal implications and potential risks involved before proceeding with the purchase.

Consulting a lawyer is a prudent step, as they can assess the specific details of your case, review the documentation and agreements related to the property, and provide you with a more informed opinion. They will be able to explain the legal requirements, potential risks, and suggest appropriate actions to address the situation.

Additionally, your lawyer can guide you on conducting due diligence, verifying the legality of the property, and ensuring that all necessary approvals and documents are in order. This is important to protect your interests as the prospective buyer and to avoid any future complications or legal disputes.

Remember, real estate laws and regulations can vary, and local expertise is essential. Seek advice from a lawyer who specializes in real estate matters in Hyderabad to get accurate and specific guidance for your situation.
