Document to be generated Sellers stay in resale flat after possession

I have entered into Agreement for sale document and the same is registered for a resale flat in mumbai and possession letter is obtained. Seller wants to stay in the resale till end sept. 19. What document do I generate which will have a legal binding in case he does not vacate the flat by the given period as Lease agreement is not the option to br exercised. Please guide what document will stand in court of law in case lease agreement is not to be entered into. Regards solomon.

If you do not wish to entered rent agreement with seller then for your safety you can execute memorandum of mutual under standing with seller and mention all the terms and conditions in there and have to do registered notary
