Do not want to take possession of flat, due to mismatch in tiles

I have booked a flat for which I have paid 20% of the total cost with the remaining 80%to be paid on possession. The builder has asked me to take possession, but on checking I've have noticed that some tiles in the bedroom are broken nd not leveled properly. On bringing it to their notice they are saying that they will replace it with darker shade tiles. What options to I have as I don't want to take possession with such mismatched tiles. The remaining payment has also not been given due to this.

You can avail to options.
1. Demand necessary repairs to be made first and make it clear to builder that you will take possession only after that.
2. Take possession but mention terms in the possession letter that such repairs will be made in particular time. If he fail to do so you can make consumer complaint where you may also get additional compensation.

Check whether the O.C is obtained by the Builder? If not, then it will be illegal to take possession of the property. Further, if O.C is obtained, you can take possession of the property but shall not pay him the balance amount until he replaces broken tiles and provides everything as per the specifications he have committed. But everything you put it in writing and demand the same from the builder.
