Do my mothers legal heirs have right on my fathers property
13-Mar-2023 (In Property Law)
My father passed before 2 years. grandmother, my mother and me are the legal heirs , my grandmother passed away before 1 year. my grandmother heirs will join legal heirs for my father?
Yes. As the daughter, widow and mother of the deceased would fall within the category of Class I legal heir, they would have equal share over the property of the deceased person. Even if the property is not devolved on them during their lifetime, their interest over the property subsists. Hence, the legal heirs of your grandmother can claim a share in the property of your father.
