Do I have the right to construct a pathway by getting shops demolished

Hello. Me and my neighbour has 2 different houses which has been joint by a single starecase. Our houses are on a same N/A plot owned by my mother and neighbour. My neighbour's house is on the side of main road of area and mine is at downside. So in the original grampanchayat approved plan (which was agreed by my mother and neighbour) there is a 6 feet wide pathway neighbour has provided us. But it not enough for a car to enter in my side of plot. when we asked the neighbour for the 10 feet he denied it. Also in original plan there was open area besides internal pathway and along with the main road. And we had given 2 feet extra from our side for the space besides the main road. But our neighbour did expansion and built shops there without our permission and also did some house expansion and built water tank and wall on the open area besides internal pathway without any permission from us CAN WE HAVE 10 FEET PATHWAY AND CAN WE MAKE OUR NEIGHBOUR DESTROY SHOPS AND EXPANDED CONSTRUCTION
