17-Sep-2024 (In Property Law)
I stay in 1 bhk flat in Kandivali west Mumbai with a family of 3 , i myself , my wife & son . The flat was bought 22 years back in joint name in the name of my mother & uncle (her brother) . On agreement there is joint name of my mother and uncle & on share certificate there is single name of my mother. Now, 5 months back my mother passed away . Do i and my family have rights on the flat ??

Yess, after the demise of your mother all her children are her legal heirs. You being the legal heir of your mother are entitled to her share in the joint property. Feel free to contact me for seeking any further legal assistance as regards the same.
